ACCESSIBILITY NOTICE AND POLICY:

Notice Under the Americans with Disabilities Act:

In accordance with the requirements of title II of the Americans with Disabilities Act of 1990 (“ADA”), the City of Neenah will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities.

Employment: The City of Neenah does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under title I of the ADA.

Effective Communication: The City of Neenah will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in City of Neenah’s programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.

Modifications to Policies and Procedures: The City of Neenah will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services, and activities.  For example, individuals with service animals are welcomed in City of Neenah offices, even where pets are generally prohibited.

Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of City of Neenah, should contact the ADA Coordinator as soon as possible but no later than 48 hours before the scheduled event.

The ADA does not require the City of Neenah to take any action that would fundamentally alter the nature of its programs or services impose an undue financial or administrative burden.

The City of Neenah will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to persons who use wheelchairs.

Meeting Accommodations: Neenah City Hall is accessible to the physically disadvantaged. If special accommodations are needed, please contact the Neenah City Clerk’s Office at 920-886-6100 at least 24 hours in advance of the meeting.

Accommodation Requests and Complaints:

In accordance with the Americans with Disabilities Act of 1990, the City of Neenah has adopted the following policy for addressing requests for reasonable accommodations made by people with disabilities in its services, activities, programs, policies, procedures, rules, and regulations.  Citizens seeking reasonable accommodations through the ADA should submit their request in writing to the City’s ADA Coordinator.

If the ADA Coordinator wishes to grant the accommodation, the petitioner will be notified within one week of receipt of the request and no further action will be required by the petitioner. The request will then be implemented by the appropriate City Department.

If the ADA Coordinator refuses to grant the accommodation request, the petitioner will be notified in writing of the decision, along with their rights to file a grievance under the City’s Grievance Procedure, in a format acceptable to the petitioner. A copy of that procedure will be included in the correspondence to the petitioner.

* Alternative means of filing a request, such as personal interviews, phone calls, or taped requests, will be made available for persons with disabilities if unable to communicate their request in writing.

Complaints that a program, service, or activity of City of Neenah is not accessible to persons with disabilities should be directed to the City’s ADA Coordinator.

NONDISCRIMINATION NOTICE AND POLICY:

The City of Neenah complies with Federal civil rights laws and is committed to providing its programs and services without discrimination in accordance with:

  • Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, or national origin (including language).

Investigation Process:

Upon receipt of the complaint, the City Attorney’s office will provide written acknowledgement to the complainant within 10 days of receipt.  Such response will notify the complainant of the review process and outline future correspondence methods.

The complaint will be reviewed to determine if the investigation can be conducted inhouse or if it will require the assistance of an appropriate external agency. 

Internal investigations should be resolved within six months while external investigations may require extended resolve due to coordination efforts.  Any investigation resulting in a referral should be done within 14 days of receipt.

Upon referring a complaint to an outside agency, the City will notify the complainant of the referral including the agency to which it was referred and the appropriate contact.  In the event of a dual filing, the City will contact the relevant agency to determine a coordination approach. 

Complaint submissions will be monitored through the City Attorney’s office in accordance with State and Federal retention requirements.

In the event complaints are made to a department or employee of the City outside of the City Attorney’s office, the recipient of the complaint should timestamp the date of receipt and immediately contact the City Attorney’s office for further instruction.
